Does Apple's Big Health App Infringe On This Company's Patents?

Apple Inc. (NASDAQ: AAPL) is facing its first lawsuit over its HealthKit and Health App from a company that developed a portable, secure device that carries a patient's medical history, according to Patently Apple. The company, LMG 3, was awarded the patent in 2007 and had been marketing the device to major health care institutions.

LMG 3's main complaint revolves around Apple's assertion that it "solved" a major problem, which LMG 3 solved in 2002 and 2003 with the creation of its device. In fact, the complaint quotes Apple's Senior Vice President Craig Federighi and Engineer Justin Rushing as evidence. The article notes that "despite Mr. Federighi's proclamation, the only ‘revolution' at work was that big players in the electronic and health industries had finally woken up to the patient-records crisis described in the Asserted Patents."

Apple has not yet responded to the lawsuit, which was filed in New Jersey District Court on Thursday, April 30.

Shares of Apple closed Friday at $128.95 and were up about 0.62 percent in Monday's pre-market session.
