Trump Sued For Battery And Defamation Again By Journalist Who Accused Him Of Rape

Former President Donald Trump was reportedly sued for a second time by a journalist who accused him of defamation earlier.

What Happened: E. Jean Carroll brought a battery claim under New York's Adult Survivors Act on Thanksgiving day, reported Reuters.

The former Elle magazine writer also accused Trump of defamation a second time. She had sued the former U.S. leader for defamation five months after he denied raping her in June 2019, according to the report.

In October, Trump labeled Carroll’s claims a “hoax” and a “lie” on Truth Social, which reportedly led to the new defamation claim.

Why It Matters: Trump was deemed a federal employee in September by an appeals court and thus immune from Carroll’s first lawsuit.

If appeals courts decide that the U.S. government could be substituted for Trump as a defendant in the 2019 case, Carroll’s first lawsuit will fail because the government has sovereign immunity from defamation claims, noted Reuters.

However, the second lawsuit, which she filed on Thursday, will not be affected as Trump is a private citizen after he ceased to be president in January 2021.
