Donald Trump Appeals Judge's Decision To Dismiss Defamation Claim Against E. Jean Carroll
Donald Trump challenges a judge’s ruling of his defamation claim against writer E. Jean Carroll‘s, reports ABC News.
The former U.S. president is urging the federal appeals court in Manhattan to overturn an Aug. 7 decision by U.S. District Judge Lewis Kaplan. Kaplan’s verdict indicated that Trump “deliberately and forcibly” assaulted Carroll.
Trump claims that Carroll defamed him by accusing him of rape. This comes after a jury awarded Carroll $5 million for defamation and sexual abuse.
Carroll, a former Elle magazine columnist, is pursuing at least $10 million from Trump in another lawsuit. Both cases originate from Trump’s denials of assaulting Carroll in a Manhattan department store in the mid-1990s.
A trial for the second lawsuit is set for Jan. 15, 2024. However, Trump seeks to postpone it during his separate appeal against the refusal to dismiss it.
Carroll’s lawyers have countered this request, emphasizing the prolonged wait and potential public disservice of an “effectively indefinite delay”.
